Mandatory for Companies to Entitle Leave on Holidays

UAE Cabinet just announced the holidays for both public and private sectors in UAE, is it mandatory for companies to follow the calendar and allow holiday to employees?


Yes As per Article 74 of Federal Law number 8 of 1980, it is mandatory for companies to entitle leave with full pay on below occasions:

1. New Islamic Year (Higri): 1 day
2. New Year’s Day (Gregorian): 1 day
3. Eid ul Fitr: 2 days
4. Eid ul Aldha : 3 days
5. Birthday of Prophet Mohammad [PBUH]: 1 day
6. Al Isra and Al Mi’raj: 1 day
7. UAE National Day: 1 day


What are the repercussions if they don’t follow the calendar?

Employers who require the services of their employees on a public holiday due to operational requirements are liable to provide their employees with compensatory leave on another day as well, as to provide such employees with additional remuneration.

Know the UAE Labour Law:

In this respect, we note Article 81 of the same law as above mentioned:
“Where the circumstances of the work make it necessary for a worker to work on public holidays or rest day in respect of which he is entitled to full or partial pay, he shall be granted compensatory leave in respect of such days, together with a bonus equal to 50 per cent of his remuneration. If he is not compensated for such days by leave, his employer shall pay him a bonus equal to 150 per cent of his basic remuneration in respect of the days worked.”

Ramadan Duty Timing:

As declared by the Ministry of Labour, working hours across the UAE throughout Ramadan are reduced by two hours for both public and private sectors, whether staff members are Muslims or not.

Many companies do not implement the two hours reduction during Ramadan?

A service articulation states that businesses are required to diminish working hours to 36 hours per week during the Holy month of Ramadan.
Companies and employees are encouraged to inform the Ministry of Labour about such violation whereby employers ask employees to work after the declared working hours during blessing month of Ramadan.

Registering a complaint in UAE is very easy, either by visiting Labour offices or in few clicks online you can register a complaint against your employer, boss, HR or manager but do you know the problems you are going to face after complaint?

Therefore, we want you to consider below 7 things before registering a complaint against your employer in UAE:

1: Know the Law and your Rights:

The first thing you need to know before complaining against your employer is to know the Law and your rights as an employee, the best way to do this is to read your contract which you have signed before availing employment visa.

This is the 3rd but important point to calculate before registering complaint, please keep in mind that you will not be the first person to register complaint, UAE Labour office (TAWAFUQ Center or TASHEEL) is always jam packed from desperate employees and there could be hundreds and thousands of cases earlier than yours.

Generally case took 2 to 3 weeks to resolve, and it is only if you agree the labour office decision, if not, your case will be forwarded to court which may take months until final hearing and decision.

The good news is that Ministry has ordered TAWAFUQ Centers to resolve and mediate between both parties within 2 working days, don’t know if the case you are going to submit can resolve in 48 hours or No but for sure officials will try their best, so keep the time duration of complaint in mind.

4: Termination or Resignation:

By registering a complaint against your employer, you may face immediate termination by company and it is something natural because registering a complaint against your employer is like an act which will displease someone.

However, we strongly recommend you to “do not leave workplace” until it is final that your are being terminated or you by yourself have resign from the job, it is better to not resign as if you have resigned you may not get the gratuity and you will have to pay 45 days full salary to company as per UAE Labour Law because you are going to breach the contract.

5: Money Matters:

Registering complaint in UAE do not cost the person but cost of living in UAE is high and a person cannot live and survive for long term without money, and off course if you have registered a complaint, you are not allowed to work anywhere in UAE until your case is cleared.

6: Proficiency in local languages and confidence:

So, make sure you have enough pocket money to survive during that perio you are not proficient in speaking English or Arabic it may affect or delay your case a little bit but it does not mean that you cannot complaint or cannot win, you will definitely get the doubt of your benefit but somehow as per our experience we have seen some expats specially unskilled workers who only speak their national languages were found in felling pressure and it is because of less knowledge, language skills and the most importantly the lack of confidence.

7: Mutual Understanding:

The best thing which me as an admin of this blog will recommend you to resolve the issue with your employer by sitting with him and final it by mutually, although I am not saying nor it is legal to negotiate your rights but sometime depends up to your situation it is best to speak with employer, for example if you are being hired by new company and they want you to join them urgently,  you must will try to clear your case as at that stage not only you but no one will miss the opportunity of new job.

Man Sexually Harassed 15 year old Girl in Mall

A man has been accused of sexually harassing a 15-year-old girl at a mall in Dubai City, also reported by Khaleej Times.

The 31-year-old Indian expat spotted the girl while her mother was busy talking to shop sales person.


Girl Report:
She said the accused grabbed her dress and pulled her to a corner in the shop located in a mall in Dubai and rushed to help her button it.

He then groped and touched her body inappropriately in the process.

She stepped back in shock and informed her mother when they left the shop.

Her mother came back and asked for help, the whole incident was captured on the surveillance cameras. Footage clearly showed the salesman had also touched himself inappropriately.

Police Report:
A police lieutenant stated: "The accused admitted during interrogations that he had helped her try on an Arabian traditional dress. While buttoning it, he said he must have touched her unintentionally while fastening the last button of traditional Arab dress which she wasn’t experienced before."

Police asked him either your are allowed to dress ladies customers? He admitted that he was not authorized to help dress customers but his Filipina colleague (salesgirl) was busy with the girl's mother so he decided to help her.

Driving license holders of some countries in the above list will require translations or consulate letters. These countries include:

(i) Canada: A letter from the Canadian Consulate in Dubai to verify that the license is genuine.

Step 1 Eye Test:

In-order to begin learning, you first need to get an eye test done either with an optician or at your driving school. If you want to check your eye sight outside school, the receipt of the test must be submitted at your driving school.

Step 2 Theory Test:

The training course begins with theory lectures and it is mandatory to take all the lectures for 8 hours before starting practical training classes.

(A) The theory test is carried out at all authorized driving schools.

(B) Don't forget to carry your Emirates ID, driving file, two photos.

(C) A total of 35 questions on road signals, hazards and guidelines on safe-driving will be asked in English, Arabic or Urdu, with more languages and translation to be added before theory test by paying extra fees.
Candidates who cannot read the touch-screen or are not computer literate can take the examination orally.

(D) The first segment with 17 questions focuses on general traffic rules and situations, and the candidate will need to answer a minimum of 11 correct to pass.

(E) The second segment has 18 questions related to the specific driving license, the candidate requires minimum of 12 correct answers to be eligible for the next test.

(F)  New segment is added to the Theory test called Risks Recognition Test, the test contains a few videos that depicts specific environmental conditions and asks the driver how he/she can cope with them.

Step 3 Practical Training Classes:

After passing the theory test, students can begin their practical training.

Important: If you have your home valid driving license which should/at least 2-5 years old you can get discount in driving classes.

(A) Students who do not possess any driving license (from any country) have to register for all 40 classes.

(B) Students possessing their country's license which is 2-5 years old have to take 30 classes.

(C) Students possessing their country license which is more than 5 years old will just be given only 20 classes.

Step 4 Parking Test:

After completing your practical training classes, your course-in charge (instructor) will advise you to book your RTA parking test and assessment test.
You need to pass 3 types of parking tests including side reverse parking, garage parking, hill training and emergency handbrake.

Step 5 Highway Classes:

After clearing your assessment and parking test, you will complete your highway training where you need to drive the vehicle above 100/kmh before going for the final road test.
Once you have completed all of your practical training classes which should be 20, 30 or 40, you will have to register for the final test.

Final Road Test:

On the date assigned, go with your passport or Emirates ID, complete driving file, 2 extra photos for the RTA License to fill up an application form, choose the date or you will be given the date as per their schedule, submit fees (around Dh310 for the road test).

On the given date, visit at least 1 hour early from your test time, you will receive an sms too,  when your name is called out, go along with the other 3 candidates and the local inspector to the designated car.
You will be given just a few minutes to demonstrate your driving skills; you have to follow all you have learned during your theory and practical classes’ in-order to pass.

Passed:
If you pass, collect the approval paper from your inspector which will be given to you same day and go to the RTA Counter.
Submit your emirates ID and your tests file at control counter with Dh100 fees.
Your driving license will be given to you at same time, printing the license can take approximately 30 minutes depending up to the branch, once you received your driving license, you are eligible to drive UAE.

Failed:
Sad thing is if you fail, you will have to register with your driving school for at least seven more practical classes and get a new road test date with all fesses to be pay again, you will rewind the same process until you passed.
